1. User Behavior

1.1. Prohibited Activities: Users must not engage in any activity that is illegal, offensive, harmful, or violates the rights of others. This includes, but is not limited to, posting misleading information, harassment, and infringing on intellectual property rights.

1.2. Respectful Interactions: Users must interact with others respectfully and refrain from abusive language, threats, and discrimination.

1.3. Content Responsibility: Users are solely responsible for the content they post, including ensuring it does not violate any laws or third-party rights.

1.4. Reporting Violations: Users are encouraged to report any violations of these terms to Tootler Platform for review and potential action.

2. Account Types

2.1. Standard Users: Can post free and fixed duration Posts with basic features.

2.2. Verified Users: Access additional features and verified status, including Custom Duration posts.

2.3. Premium Users: Paid membership with exclusive benefits such as additional customization options, access to Targeted-Broadcast, and post archiving for up to 6 months.

3. Posting and Duration

3.1. Types of Posts: Users can post free, paid, custom duration, and geographically targeted Posts. Promotion options are available for all types of Posts except for Targeted-Broadcast.

3.2. Promotion: Users can choose to promote their posts (except Targeted-Broadcast) to increase visibility. Tootler Platform will provide an estimated number of views based on the duration of the post, but these are estimates only and not guaranteed.

3.3. Auto-Deletion: Posts will automatically delete once the specified duration expires without renewal, except for posts by Premium users which will be archived for up to 6 months. Users will not receive refunds for any unused time or early termination.

3.4. Ad Content: Posts must be truthful and not misleading. Any claims made in Posts must be substantiated.

4. Payment Terms

4.1. Processing Payments: All payments for premium membership and paid ads and services are processed via online or via carrier payment services (If applicable).

4.2. Non-Refundable Fees: All fees are final and non-refundable, regardless of whether the service was used fully or partially.

4.3. Payment Disputes: Any payment disputes must be reported within 5 business days. After this period, all transactions are considered final.

5. Platform Rights

5.1. Account Termination: We reserve the right to terminate or suspend any account, or remove any content, at our sole discretion without notice or liability.

5.2. Content Moderation: We have the right to monitor, edit, or remove any content that we determine violates these terms or is otherwise objectionable.

5.3. Verification Requests: We reserve the right to hold, reject, or disapprove any verification requests at our sole discretion without providing a reason.

6. Data Collection and Storage

6.1. Cookies: By using our platform, you agree to our use of cookies to enhance user experience and analyze site usage.

6.2. Personal Data: We collect various types of data including but not limited to:

6.2.1. Personal Information: Names, email addresses, phone numbers.

6.2.2. Location Data: Geographic location information.

6.2.3. IP Addresses: Information about users' internet connection.

6.2.4. Activities: User interactions, posts, and behaviors on Tootler Platform.

6.2.5. Payment Details: Transaction information including payment methods and history.

6.2.7. Verification Documents: ID and passport copies, bank statements, business and company registration numbers and certificates, and any other documents required for user authentication.

6.3. Data Usage: Collected data is used to improve services, personalize user experience, and for marketing and analytics purposes.

6.4. Data Sharing: We may share user data with third parties in compliance with our privacy policy and industry practices. This may include marketing, analytics, or service improvement purposes.

6.5. Third-Party Services: Tootler Platform may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.

7. Limitation of Liability

7.1. No Liability for Damages: Tootler Platform shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or connected to your use of or inability to use our services. This exclusion applies regardless of the theory of liability and even if you have advised us of the possibility of such damage.

7.2. No Guarantee of Data Security: While Tootler Platform implements reasonable measures to ensure the security of your data on our platform, we cannot guarantee absolute security or confidentiality of user data during posting or transactions. By using our services, you acknowledge that any information shared or received on our platform is done at your own risk.

7.3. Service Interruptions: Tootler Platform does not guarantee uninterrupted or error-free operation of our services and will not be liable for any interruptions, including but not limited to system failures, data loss, or unauthorized access.

7.4. Service Uptime: Tootler Platform commits to reasonably maintaining the uptime of our services, however, unexpected downtime due to system maintenance, upgrades, or other factors beyond our control. Tootler Platform aims to achieve a high service uptime annually. Should there be unscheduled downtime, we will endeavor to restore service if possible and keep users informed about the status of our services, if the communication within Tootler Platform or privately is not feasible or limited for any reason, we might communicate a public status message as necessary.

7.5. Disclaimer and Limitations of Liability: Our services involve complex algorithms for distributing content and ads. Tootler Platform disclaims all liability related to algorithm accuracy and does not guarantee that the content distribution will meet specific performance metrics or that the results of campaign metrics will be accurate or reliable. Advertisers and users acknowledge that variances in content delivery and ad performance are inherent and accept the risk of such variances.

7.6. No Guarantee: We make no guarantees regarding the precise effectiveness, reach, or success of posted content or advertisements on our platform. Performance outcomes can vary widely based on numerous market and technological factors.

7.7. Force Majeure: Tootler Platform is not liable for any failure to perform our obligations under these terms due to events beyond our control, including but not limited to natural disasters, war, fire, floods, accidents, network infrastructure failures, or shortages of transportation, technical support, or administrative facilities.

8. Intellectual Property

8.1. User Content: Users retain ownership of their content but grant Tootler Platform a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute the content.

8.2. Platform Content: All other content on Tootler Platform is owned by Tootler Platform and is protected by intellectual property laws. Users may not use this content without explicit permission.

8.3. Infringement Claims: If you believe your intellectual property rights have been violated, please contact us with detailed information so we can investigate the matter.

9. Service Modifications

9.1. Changes to Services: We reserve the right to modify or discontinue any part of our services at any time without prior notice. This includes the introduction of new features or changes to existing ones, its costs and fees, and its functionalities.

9.2. Terms Updates: We may update these terms periodically. Continued use of the service after such updates will constitute acceptance of the new terms.

10. Data and Transactions Security

10.1. Security Measures: We implement reasonable security measures to protect user data, but we do not guarantee absolute security. Users are responsible for maintaining the confidentiality of their account information.

10.2. Encryption Disclaimer: We do not guarantee the encryption of data during transmission or storage. Users should take precautions to protect their own data.

10.3. Data Breaches: In the event of a data breach, we will notify affected users as required by law and take steps to mitigate the breach.

11. Identity Theft

11.1. User Responsibility: Users are responsible for safeguarding their login credentials and must notify us immediately if they suspect any unauthorized use of their account.

11.2. Platform's Role: Tootler Platform is not responsible for identity theft or any damage arising from unauthorized use of user accounts. Users should take appropriate security measures to protect their identity.

12. Restoration of Deleted Items

12.1. Auto-Deletion Policy: Ads and posts are automatically deleted after their specified duration for all users except the premium user, their posts will be archived for a certain period. In all cases, when the post is deleted automatically or manually this action is irreversible and the items cannot be restored.

12.2. No Liability for Deletion: Tootler Platform is not liable for any loss of data or content due to auto-deletion.

13. Unwanted or Unexpected Results

13.1. User Responsibility: Users are responsible for the content they post and any consequences arising from it, including unexpected or unwanted results.

13.2. No Guarantees: We do not guarantee any specific outcomes from the use of our services. Users should use Tootler Platform at their own risk.

14. Comments and Review Scores

14.1. User Reviews: Users can post comments and reviews on ads and profiles. These reviews reflect the opinions of individual users and do not represent the views of Tootler Platform.

14.2. Impact on Reputation: Users acknowledge that comments and reviews may impact their reputation. Tootler Platform is not responsible for any consequences resulting from user reviews.

14.3. Moderation: We reserve the right to moderate and remove any comments or reviews that violate our terms or are deemed inappropriate.

15. Creation of Multiple Accounts

15.1. To maintain the integrity and low spamming, the creation of multiple accounts by a single user is strictly not permitted.

15.2. Users are generally expected to create and use one account only. Multiple accounts for individual use are discouraged and may be subject to review and potential action if used for deceptive practices or to circumvent site policy.

15.3. Users who wish to create accounts for business purposes or operational needs should obtain prior approval from Tootler Platform. Accordingly, those accounts should be verifiable for business or operational needs.

16. Governing Law and Dispute Resolution

16.1. Jurisdiction: These terms are governed by the laws of Saudi Arabia. Any disputes arising from these terms will be resolved in the courts of Saudi Arabia.

16.2. Dispute Resolution: Users agree to first contact Tootler Platform directly to seek an internal resolution for any disputes or concerns arising from the use of our services. If the dispute cannot be resolved to the mutual satisfaction of both parties through internal processes, users may then submit the dispute to the local court system in Saudi Arabia where our main office is located. Furthermore, you agree that any claims against Tootler Platform must be brought in your individual capacity, and not as a plaintiff or class member in any class or representative proceeding. This clause does not prevent you from participating in any matter brought by a government agency.

17. User Feedback

17.1. Feedback Submission and Use: Users may submit feedback, suggestions, or ideas about Tootler Platform. By submitting feedback, users grant Tootler Platform the right to use and implement this feedback without any compensation and or intellectual right to the disclosing users of any kind.

18. User Safety

18.1. No Harm Policy: Users must not expose each other to harm of any kind or level, whether physical, emotional, or psychological. Any such behavior will be grounds for account termination.

18.2. Avoiding Scams: Users should exercise caution and due diligence to avoid becoming victims of scams or fake ads. Tootler Platform is not responsible for any losses or damage resulting from users' interactions or transactions on Tootler Platform.

19. Prohibited Content

19.1. Tootler platform is dedicated to promoting safe and legal interactions for the buying, selling, negotiation, business promotion, and brand awareness activities. To ensure a secure and compliant environment, certain types of content are strictly prohibited. Posting any of the following content types may result in immediate account suspension or termination, and may also lead to legal action, depending on the severity of the violation:

19.2. Adult Sexual Content: Any content that includes sexually explicit material, pornography, or any material meant to cause sexual influence.

19.3. Fraudulent Content: Posts that are intended to deceive or cheat users through false representations or scams.

19.4. Pharmaceutical, Drugs, Tobacco, and Alcohol: Unauthorized or illegal drugs, prescription medications, tobacco products, and alcohol are not permitted.

19.5. Gambling Content: Any content related to gambling, including online casinos, sports betting, lotteries, or any form of betting.

19.6. Hateful and Inappropriate Content: Content that promotes hate speech, bigotry, racism, discrimination, or harm against any individual or group.

19.7. Malware and Software: Content that intends to disrupt, damage, or gain unauthorized access to any system, data, or personal information.

19.8. Political Content: Content that involves political influence, discussions, and doesn’t fall under that platform`s business targets are not permitted.

19.9. Dating and Marriage Services: Content related to dating and marriage services is strictly not permitted and doesn’t fall within Tootler Platform business targets.

19.10. Human trafficking: Content that facilitates or promotes human trafficking in any way, including advertisements, solicitations, or any form of communication that could be interpreted as supporting such activities, is strictly banned. Violation of this policy will result in severe actions, including the immediate termination of accounts and legal action, as necessary.

19.11. Bylaw Prohibited Content: Any content that is prohibited under local, national, or international law.

19.12. Cryptocurrency and NFTs Content: Promotions, offers, or advertisements related to cryptocurrencies and NFTs are not permitted.

19.13. Weapons and Weapon Accessories: Any postings involving the sale or promotion of weapons, ammunition, and related accessories.

20. Legal Recourse and Platform's Role

20.1. Reporting to Authorities: Users have the right to report harassment or illegal activities by other users to law enforcement authorities. Tootler Platform will cooperate with law enforcement only when required by a court order.

20.2. Platform's Non-Interference: Tootler Platform is not obligated to provide support or intervene in disputes between users without a court order. This includes any issues arising from harassment, scams, or illegal activities.

20.3. Protection of Platform Interests: Users must not engage in any actions that could harm the reputation, business, employees, investors, subsidiaries, partners, customers, or other users of Tootler Platform. Any disputes should be resolved legally and without damaging Tootler Platform or its stakeholders.
